Federal Litigation

When an application is pending for too long without a decision, you may be able to file a lawsuit in federal court (called a writ of mandamus) against the agency to compel the agency to adjudicate. As former USCIS attorneys, we have extensive experience with litigation seeking to hold agencies like U.S. Citizenship and Immigration Services and Department of State accountable for violations of the Administrative Procedure Act (APA), 5 U.S.C. § 706(1), for failing to adjudicate cases in a timely and fair manner. We can assist you with filing the lawsuit on your behalf and, in many cases, the agency expedites the adjudication of the filed petition- usually within 60 days of serving the lawsuit.

IMMIGRATION NEWS ALERT: Executive Order Establishes New Gold Card Immigrant Visa Program

On September 19, 2025, a new Executive Order was signed, creating a direct immigration pathway for high-net-worth individuals and corporations. The new "Gold Card" visa program, overseen by the Department of Commerce, will facilitate an expedited route to a U.S. visa for those who make a significant financial contribution to the Nation. This program provides an alternative to traditional employment-based visas and the existing EB-5 Immigrant Investor Program. The order specifies a gift of $1 million for individuals and $2 million for corporate-sponsored applicants, with the funds allocated to support American industry. The implementation of this program is underway. Our firm is closely monitoring the development of all application and adjudication procedures.
